Informative notice pursuant to article 13 of legislative decree 196/03

Dear SUPPLIER, we wish to inform you that your personal data will be processed by our company, in compliance with Legislative Decree 196/03. Your data will be entered into our company databases with your consent, with the exception of cases such as those outlined by article 24 of Legislative Decree 196/03.
On the basis of this regulation, the processing will come about in accordance with the principles of correctness, legality and transparency, protecting your rights and your confidentiality.
Pursuant to article 13, we hereby inform you that:

  1. The aims of the personal data processing are the following:
    • Fulfilment of the contracts stipulated with you and the associated commitments;
    • Compliance with legal obligations associated with the contractual relationship;
    • Fulfilment of accounting obligations;
    • Fulfilment of banking obligations;
    • Organisational management of the contract;
    • Internal statistical analyses.
  2. Your data will be processed both on paper and in an electronic format, adopting all of the measures necessary to guarantee safety and confidentiality.
  3. You are obliged to supply the information in question in relation to the aforementioned aims. The supply of information for purposes other than those mentioned above is understood to be optional.
  4. Refusal to supply the data for such aims will lead to us being unable to undertake any commercial relations with you.
  5. Your data includes the following:
    • identification data (corporate name, headquarters, telephone, fax, e-mail, tax data etc…)
    • data relating to your business activity (bank details, accounting details etc…)
  6. This data has been supplied by you directly or it may be collected from autonomous third parties who are nominated as data processing managers (networks of agents, sales information companies etc…)

Your personal data will be entered into the relevant database, to which the employees of the purchases, marketing, production, order delivery, quality and administration departments have access as long as they are specifically appointed by the company as data processing officers and they will be able to carry out operations of consultancy, use, processing and comparison and all other operations that may prove opportune with respect for the legal dispositions and that are aimed at guaranteeing the confidentiality and secrecy of the data and the exactness, updating and pertinence of the same with respect to the aims declared.
  8. In relation to the aims indicated in point 1, your data may be communicated to the following persons or categories of persons:
    • transportation or dispatch companies for matters relating to the receipt of merchandise or customs formalities.
    • Banks for the management of payments
    • Financial administrations and other companies or public bodies in compliance with legal obligations.
    • Companies and legal firms for the protection of contractual rights.
  9. 9. You may contact the data processing manager or supervisor to ensure that your rights are being respected as foreseen by article 7 of Legislative Decree 196/03, that is, to obtain confirmation of whether or not data regarding you exist, cancellation of the same, transformation of the same to an anonymous form and blockage of any data processed in violation of the law, updating, rectification or integration of data, certification that the operations described have been communicated to those to whom the data was communicated or distributed.

Art. 7 Access rights regarding personal data and other rights
  1. The interested party has the right to obtain confirmation of the existence or otherwise of personal data regarding the same, even if such has not yet been registered and the communication of the same in a comprehensible form:
  2. The interested party has the right to obtain indications regarding:
    1. The origin of the personal data;
    2. the aims and manners in which such data is processed;
    3. the logic applied in cases where processing is carried out with the use of electronic means;
    4. the identification details of the director, supervisor and the representative appointed in accordance with article 5, paragraph 2;
    5. the subjects or categories of subjects to whom the personal data may be communicated or that may come to know of such data as the appointed representative within the State, of those responsible or those appointed.
  3. The interested party has the right to obtain:
    1. Updating, rectification or, when he / she wishes to, integration of the data;
    2. b) The cancellation, the transformation into an anonymous format or the blockage of any data that is processed in violation of the law, including data that it is not necessary to store in relation to the aims for which it was collected or subsequently processed;
    3. c) certification that the operations as per letters a) and b) have been communicated to those to whom the data was communicated or distributed, with the exception of cases where such proves impossible or where such involves the use of means that are greatly disproportionate with respect to the right being protected.
  4. 4. The interested party has the right to oppose, either wholly or in part
    1. a) to the processing of his or her personal data for legitimate reasons, as long as such reasons are relevant to the aims for which the data was collected;
    2. b) to the processing of personal data regarding the same for purposes relating to the sending of advertising material or direct sales material or for the fulfilment of market research or sales communication activities.
